Issue
Competing claims to a life insurance benefit owed to minor children

The insured’s life insurance benefit was claimed for his two minor children, through their parent, and by another claimant. The insurer filed an interpleader, deposited the benefit with the court and was discharged.

We represented the children. The other claimant never answered, and after a hearing the court entered a default judgment that she takes nothing from the policy proceeds. Because our clients are minors, the court then ordered the entire benefit, with interest, paid into a trust held for them until they reach adulthood.

What it shows. An interpleader can secure a child’s full benefit when another claimant does not defend, and the court can direct the money into a trust for the child.
