Case
American General Life Insurance Co. v. DeLong
Court
U.S. District Court, Northern District of Georgia
Docket
No. 1:21-cv-00790-JPB
Decided
July 19, 2022
Issue
A challenge to beneficiary changes for fraud, undue influence and incapacity, resolved by agreement

The insured changed the beneficiary of his life insurance policy to name our client. His mother contended the changes resulted from fraud, undue influence, misrepresentation, duress or lack of capacity. The insurer deposited the benefit and was dismissed.

We represented the named beneficiary. The claimants resolved the dispute by agreement, and the court entered a final judgment ordering the registry funds disbursed, with our client receiving the amount shown. No court ruled on the challenge.

What it shows. Serious allegations against a beneficiary change still have to be proved, and many of these disputes end in a court-ordered resolution before trial.
